Where a will last in the testator's possession cannot be found after death, the presumption of destruction animo revocandi applies and must be rebutted by the party propounding the will. Where all interested parties are on notice of the lost will and none wishes to propound it, the court need not investigate the presumed revocation further. Hearsay statements of a deceased testator expressing dissatisfaction with the terms of a will are admissible on the issue of whether the testator had an inclination to revoke it by destruction.
