On an appeal against the type of sentence imposed (immediate imprisonment rather than suspended), the appellant must demonstrate that the sentencing judge erred in imposing immediate imprisonment — that is, that the sentence was unreasonable or unjust — not merely that suspension was reasonably open. A sentencing judge is not bound by prosecution concessions as to the appropriate sentencing option. For aggravated armed robbery involving home invasion with weapons and in company, the seriousness of the offending may outweigh youth, prior good character, guilty plea and cooperation, with those mitigating factors being appropriately reflected in the reduced length rather than the type of sentence.
