General damages of $70,000 were awarded in 2012 for a child plaintiff who underwent unnecessary corrective surgery and hardware removal surgery for a negligently treated forearm fracture, resulting in two permanent scars of 12 and 13 centimetres. The court applied a 4% interest rate on past general damages following MBP (SA) Pty Ltd v Gogic and 9% on past out-of-pocket expenses. A grossly inflated claim for gratuitous care (2,311 hours claimed, 100 hours allowed) was criticised.
