An application to restrain solicitors from acting on the basis of a conflict of interest or duty may be refused where the applicant has delayed nearly five years in bringing the application, particularly where a certificate of readiness has been filed and a hearing date fixed. The same principle of promptness applicable to interlocutory injunctions applies to such applications. The court will have regard to the prejudice to the other party in having to change solicitors close to trial.
