The principles in Dietrich v The Queen concerning the right to legal representation do not extend to civil extradition review proceedings where the appellant was previously represented and has himself instituted the appeal. Challenges to decisions made at earlier stages of the extradition process (s 16 notice, s 19 determination) cannot be re-litigated in the context of judicial review of the Minister's s 22 surrender decision, and attempts to do so constitute an abuse of process. A party is bound by concessions made by counsel at trial and cannot ordinarily revive conceded points on appeal.
