Where both parties have accepted the validity of a contract in separate proceedings (here, arbitration), a trial judge's failure to invite submissions on a specific element of contractual validity (consideration) does not constitute operative procedural unfairness, because raising the point could not have altered the result. A party cannot complain on appeal of a departure from pleadings where the trial was fought on enlarged issues and the party was content to make closing submissions on the altered battle lines.
