Under the Dust Diseases Tribunal claims resolution process, a defendant who has paid more than its proportionate liability can enforce an assessor's apportionment determination against any party found liable, including a cross-defendant with whom it has no direct proceedings. The contributions assessment determination under cl 52(1) of the Dust Diseases Tribunal Regulation 2007 (NSW) extends beyond payment of the plaintiff's damages to permit recoupment between defendants after the plaintiff has been paid in full.
