An email sent by a person using a corporate title constitutes a business record of the company admissible under s 69 of the Evidence Act 1995 to prove the truth of the representation as to the person's position. Section 161 of the Evidence Act creates a presumption that the email was sent by the company, and s 183 permits the inference that a copy was retained as part of the company's business records. Where a sole director authorises a person to submit a credit application using a corporate title, s 129(3)(b) of the Corporations Act 2001 entitles third parties to assume that person has authority customarily exercised by an officer holding that title.
