In assessing expectation damages for breach of contract, there is no absolute principle requiring deduction of overhead expenses. Only costs actually saved by the breach are to be deducted; fixed costs that did not abate are not deductible. The absorption method of cost accounting endorsed by McHugh J in Dart Industries for patent infringement does not apply to expectation damages claims. Section 146(2) of the Evidence Act 1995 concerns only the mechanical reproduction of documents, not the accuracy of underlying information.
