Prospects of success on a costs appeal are not a sufficient reason for granting leave to appeal on costs under s 101(2)(c) of the Supreme Court Act 1970 (NSW). Even where the quantum at stake is several hundreds of thousands of dollars, this does not tip the balance in favour of granting leave where the application is in substance one to re-exercise the trial judge's discretion.
