When assessing whether to grant a pro bono referral under UCPR 7.36, the court must consider whether the proposed proceedings have reasonable prospects of success. A disclosed and uncontested ground of apprehended bias will not provide reasonable prospects of success on appeal. Applications for waiver of court fees should be made to the Registrar under cl 11 of the Civil Procedure Regulation 2005, not to a judge in the first instance.
