A trial judge's assessment of diminution in earning capacity must be internally consistent: where a judge finds that certain symptoms are consequences of the tortious act, the judge cannot then assess economic loss on the basis that those same symptoms are not consequences of the act. Post-injury conduct (such as obtaining qualifications and employment) may be relevant evidence of pre-injury intention to enter the workforce and should not be disregarded merely because it occurred in the context of litigation, particularly where that proposition was not put to the plaintiff in cross-examination.
