An employer's duty to provide a safe system of work does not require elimination of all risk; where an employee is positioned in a location that serves an important safety function for others, and the probability of injury is extremely low, the employer is not required to adopt an alternative system that would reduce the employee's effectiveness. Parties who agree to extensions of time for pre-filing procedures under the WIM Act will be held to those agreements and cannot later rely on the original time limits to strike out the opposing party's pleadings. Rule 17.7(6) of the Workers Compensation Commission Rules 2006 was beyond power.
