An appeal from the Medical Tribunal under s 162(1)(a) of the Health Practitioners Regulation National Law Act 2009 (NSW) is confined to decisions with respect to a point of law; challenges to the Tribunal's preference for one body of expert evidence over another, the weight given to evidence, and findings of fact do not raise points of law. A stay cannot be granted of a deregistration order that has already taken effect. Review of a single Judge of Appeal's decision under s 46(4) of the Supreme Court Act 1970 (NSW) requires demonstration of error in principle or that the order was clearly wrong.
