A mortgage originator who certifies identification of a borrower by reference to a passport photograph but submits a loan application with forged signatures breaches its obligation of reasonable care, as the strong probability is that the originator did not compare the passport photograph with the person before them. The possibility of successful impersonation while carefully comparing a passport photograph is remote. For proportionate liability under the Civil Liability Act 2002, a defendant must plead and prove that alleged concurrent wrongdoers are liable to the plaintiff.
