The Court of Appeal varied its earlier orders under UCPR r 36.16(1) to include dismissal of the respondent's motion filed at first instance and a costs order in the appellant's favour, correcting an oversight in the original appeal orders. The Court confirmed it had power to vary orders where the motion was filed within the 14-day period under UCPR r 36.16(3A), and ordered costs of the correction motion against the respondent who had unsuccessfully opposed it.
