A driver travelling in a through lane has no obligation to slow down or give way to facilitate a merging vehicle's lane change where the merging vehicle is required to give way under r 148(1) of the Australian Road Rules. The mere activation of an indicator in a merging lane does not impose a duty on through-lane drivers to take particular action or maintain constant surveillance of the merging vehicle. A three-metre gap at 40 kph is insufficient for a safe lane change.
