A submitting appearance filed deliberately on legal advice may be withdrawn where there has been a material change in circumstances, such as the loss of legal representation by a co-party in the same interest. Leave will ordinarily be granted subject to conditions compensating the other party for prejudice, including payment of costs thrown away and provision of security for costs. The evidence must not establish that the security order would stymie the appeal.
