Costs before the Appeal Panel of the Administrative Decisions Tribunal are to be determined on the basis of the arguments presented to it, not on some abstract assessment of merit, and the length of the hearing is not the sole measure of whether proceedings have been unreasonably prolonged. An erroneous reference to the source of a statutory power is immaterial where the correct provision was substantively applied. The right of appeal under s 119 of the Administrative Decisions Tribunal Act 1997 (NSW) is not narrower in scope than the supervisory jurisdiction of the Supreme Court.
