A successful appellant is not deprived of costs merely because the determinative statutory provision was raised by the Court during oral argument rather than by the parties, provided both parties addressed the issue. Appeals are against orders, not reasons, so the failure of some arguments does not require the appeal to be allowed only 'in part'. No costs order is appropriate on a defensive cross-appeal that becomes academic.
