There is no requirement to re-arraign an accused person after empanelment of the jury where the accused has already been arraigned in the presence of the whole jury panel, even where the court previously exercised jurisdiction under s 130(2) of the Criminal Procedure Act 1986 to determine legal issues before empanelment. A Crown Prosecutor may refer to a complainant's spontaneous response challenging the suggestion that she was lying, provided the Crown does not cross the line of suggesting the accused bears an onus to establish a motive to lie. Where defence counsel specifically agrees to the terms of a direction regarding admission evidence, the trial judge is not required to give a direction in the full terms of s 165(2) of the Evidence Act 1995.
