A ground of appeal asserting that a sentencing judge had 'insufficient regard to' a particular factor is in substance a ground of manifest excess, not a separate error of process. Form 1 offences do not constitute double counting where they encompass criminality beyond the primary offence — for example, possession of a safebreaking implement not used to achieve entry, or malicious damage committed during escape that was not necessary to complete the break enter and steal.
