Where a sentencing judge's remarks reveal that the standard non-parole period was treated as a mandatory starting point from which departure was permitted only to the extent the subjective case allowed, this constitutes operative Muldrock error warranting re-sentencing. Following Muldrock, the sentencing court need not attempt to quantify the distance between the actual offence and a putative offence in the middle of the range of objective seriousness.
