A finding that co-offenders in a joint criminal enterprise are 'equally responsible' for the criminal act reflects their shared criminal liability, not a finding of equal culpability. The parity principle is not engaged where the sentencing judge makes legitimate factual findings establishing different degrees of culpability based on each offender's particular conduct. A sentencing judge's indication of a guilty plea discount that is expressly conditional on the Crown's submissions does not give rise to a legitimate expectation or procedural fairness obligation where the Crown subsequently submits the discount should be lower and the offender has the opportunity to respond.
