A bare assertion or diagnosis of mental disorder on a hospital form, without supporting psychiatric evidence, is insufficient to establish unfairness under s 90 of the Evidence Act 1995 so as to exclude confession evidence. The accused bears the onus of establishing unfairness, and the potential for prolonging a trial due to reliability arguments is an irrelevant consideration in the exercise of the s 90 discretion.
