An application for criminal compensation under s 663B of the Criminal Code brought within the six-year limitation period running from conviction cannot be dismissed on the basis of delay alone. An order that no conviction be recorded does not deprive the aggrieved person of entitlement to criminal compensation, because s 12(4) of the Penalties and Sentences Act 1992 preserves the court's power to make orders under other Acts.
