Section 15 of the Appeal Costs Fund Act 1973 (Qld) empowers the Court to grant indemnity certificates only to respondents to an appeal, not to appellants. A successful criminal appellant whose conviction is quashed and a new trial ordered has an entitlement under s 22(1)(b) to payment from the Appeal Costs Fund, but that entitlement is administered by the Board, not the Court. Applications for indemnity certificates must be made within 14 days of judgment delivery under Practice Direction 2 of 2010.
