A solicitor retained to act in loan transactions has a duty extending beyond mechanical document preparation to ascertaining the client's understanding of the transactions, evaluating risks, and advising on the need for legal protection, particularly where the client is unsophisticated. This duty exists even where the client does not specifically request advice. Hearsay evidence admitted without objection as part of an agreed bundle of documents in Queensland becomes evidence for all purposes where no restriction on its use is stated at the time of tender.
