A trial judge's prompt, clear and emphatic directions to disregard brief inadmissible opinion evidence are effective to prevent a miscarriage of justice, particularly where the evidence occupied only a short time, the prosecutor did not seek to exploit it, and the jury's subsequent conduct suggested conscientious compliance with directions. Defence counsel's failure to object to inadmissible evidence does not militate against a finding of miscarriage where the failure is not objectively explicable as a forensic decision.
