The Queensland Court of Appeal dismissed an appeal against a stalking conviction entered on a guilty plea, holding that unsworn assertions from the Bar table about alleged bad legal advice (including a claim the plea was on a 'no contest' basis) and alleged unsoundness of mind were insufficient to establish a miscarriage of justice warranting the setting aside of a plea of guilty made in clear terms. The Court emphasised that the appellant had not put any material on affidavit and that arguments about the complainant's signature had already been ventilated before the plea was entered.
