An offender's ill-health will not mitigate a sentence for maintaining an unlawful sexual relationship with a child unless there is evidence that imprisonment would be a greater burden by reason of the offender's state of health or would have a gravely adverse effect on health. A medical report detailing multiple conditions without addressing the impact of imprisonment is insufficient. A sentence of four and a half years imprisonment with parole eligibility after 18 months was within range for maintaining a sexual relationship with a four-year-old child involving oral sex, masturbation, and requiring the child to consume ejaculate over approximately six occasions.
