A collision analyst's expertise in accident investigation does not extend to the interpretation of images from video or CCTV footage; such interpretation is a matter for the jury unless a witness with relevant specialised qualifications is called. The admission of such inadmissible opinion evidence on a matter central to the defence case will occasion a miscarriage of justice, and the proviso will not apply where a jury on properly admissible evidence could entertain a reasonable doubt.
