The Minister's power under s 26A of the TPC Act to make change of purpose declarations applies to transport land regardless of whether it was acquired by the State or by a local government. 'Another stated transport purpose' in s 26A(2) means an additional purpose, not necessarily an alternative or substitute purpose, so the original purpose may subsist. The definition of 'transport land' contains a temporal bifurcation: paragraph (a) ('has been acquired') looks to the time of acquisition, while paragraph (b) ('is required') looks to the time the s 26A declaration is made.
