Permitting s 93A video-recorded statements to go into the jury room during deliberations without exercising the s 99 discretion, without discussing the procedure with counsel, without warning the jury against disproportionate weight, and without reminding jurors of cross-examination evidence, constitutes a material irregularity and error of law that will not be saved by the proviso, even where defence counsel did not object at trial.
