A conviction based on a guilty plea will not be set aside where the applicant signed detailed written instructions confirming understanding of the charges, the evidence, and the right to trial, and where the plea was a considered trade-off to obtain a more lenient sentence, even where the applicant later asserts he was promised a particular sentence by the prosecutor. The Crown's inability to identify the accused through direct eyewitness evidence does not render a guilty plea unsafe where there is strong circumstantial evidence.
