Where a solicitor's firm faces potential liability if a client's claim is unsuccessful because the claim arises from the firm's own error, the firm has a real conflict of interest that will ordinarily require it to cease acting. The presence of independent counsel does not cure the conflict because the solicitors control instructions to counsel and the retainer. The conflict exists regardless of whether the solicitor who made the error was a partner or employee of the firm.
