Evidence of extensive, intricate and ongoing planning and management of criminal activity is relevant to the application of R v Verdins principles in two ways: it can indicate the level of severity of the mental condition and the extent to which it affects capacity to function, and it can be relevant in assessing the existence or strength of any causal link between the condition and the offending. Tentative expert evidence using language such as 'it is possible' and 'could have contributed' will not satisfy the requirement for cogent evidence of the causal relationship.
