The strength of the Crown case is irrelevant to the utilitarian component of a guilty plea discount and can only reduce the subjective component (remorse, willingness to facilitate justice) where contextual evidence — beyond the strength of the case alone — supports an inference that those subjective criteria are limited or absent. Where uncontradicted evidence or accepted submissions establish remorse, the strength of the Crown case will not ordinarily reduce the subjective discount. A sentencing judge need not separately address objective and subjective criteria unless concluding that less than the full discount should be allowed for one or both.
