The phrase 'whose acts or omissions caused' in s 24AH(1) of the Wrongs Act 1958 (Vic) does not require the word 'directly' to be read in. A defendant who has acquired responsibility for another's causative conduct by statutory transfer or novation before damage occurred is arguable as a 'concurrent wrongdoer' for proportionate liability purposes. The question was not finally determined but held to be sufficiently arguable to permit amendment of pleadings.
