Covert recording of conversations between a prisoner and a visiting spouse does not engage the unfairness or public policy discretion where the police purpose was to respond to the prisoner's own approach regarding a possible deal, and the spouse was not acting as a police agent. A sentencing judge is not bound to fix a non-parole period that guarantees the offender life after prison; the avoidance of a crushing sentence is not an absolute requirement but a matter to be achieved if possible without undercutting the minimum term justice requires. Harsh prison conditions (including effective solitary confinement) do not of themselves warrant appellate reduction of an otherwise appropriate sentence.
