A sentencing judge's finding that an offender's mental impairment did not reduce moral culpability is a finding of fact that will attract appellate intervention only if it was not reasonably open on the evidence. Where a co-offender receives the same sentence despite the applicant's guilty plea, parity is not offended if the co-offender had countervailing mitigating factors (here, advanced age and poor health) that the applicant did not share.
