Section 243 of the Criminal Procedure Act 2009 (Vic) permits transfer to the County Court only of summary offences, not indictable offences triable summarily; Commonwealth offences punishable by more than 12 months' imprisonment are indictable under s 4G of the Crimes Act 1914 (Cth) regardless of how they are commonly described. Where convictions are quashed and the usual appellate powers under s 277 are inapt, s 168 provides an alternative mechanism for the Court of Appeal to transfer indictable offences triable summarily to the Magistrates' Court.
