The Dobree v Hoffman rule denying costs to self-represented solicitor-litigants does not automatically apply where the solicitor-litigant is represented by an incorporated legal practice that is a separate legal entity and not a party to the proceedings. However, the court retains a discretion to deny costs applying the rationale of Dobree v Hoffman even in the incorporated practice context. Where costs are allowed, the court may still exclude allowances for time spent by the solicitor-litigant personally.
