An appeal may be dismissed under r 43(2)(g) of the Supreme Court (Court of Appeal) Rules 2005 (WA) where the appellant has failed to file their case as required and none of the proposed grounds has a reasonable prospect of success. Costs may be awarded against an unsuccessful criminal appellant under s 14(1)(h) read with s 18 of the Criminal Appeals Act 2004 (WA) where there has been significant non-compliance with the Rules and the grounds are wholly without merit.
