An appeal by way of rehearing on the record in child protection proceedings is confined to the grounds of appeal and the record before the magistrate; the appellate court is not entitled to intervene unless a material error of law or fact or miscarriage of justice is established. The doctrine of res judicata does not preclude a magistrate from making a different protection order on a subsequent application for variation or revocation, as the statutory scheme contemplates changed circumstances and the paramount consideration remains the best interests of the child.
