A misapprehension as to the seriousness of an offence and the likely penalty does not constitute a 'material misunderstanding as to the charge, the plea or the purpose of the proceedings' under s 99(5)(b) of the Criminal Procedure Act 2004 (WA). A prior conviction for the same offence in similar circumstances is relevant to whether the accused misunderstood the charge.
