Section 334 of the Crimes Act 1900 (ACT) is available at every stage of a summary trial without requiring a plea of guilty. The 'seriousness of the alleged offence' under s 334(3)(e) is assessed by reference to both the maximum penalty and the circumstances of the alleged conduct. The decision is discretionary and subject to House v The King review. There is no right of appeal from a s 334 decision under pt 3.10 of the Magistrates Court Act, though prerogative relief may be available for jurisdictional error.
