A general oral warning about the kinds of risks present in a recreational activity (e.g., 'there are sticks and obstacles, don't run full out or you might fall') is capable of constituting a 'risk warning' under s 5M of the Civil Liability Act 2002 (NSW), negating the duty of care. The warning need not identify the specific hazard that later causes injury; requiring identification of a specific obstacle is impermissible hindsight reasoning. The fact that a recreational activity involves competitive running does not convert an otherwise obvious risk of tripping in bushland into a non-obvious risk for the purposes of s 5F.
