Costs incurred in pumping or diverting water to protect insured property from further damage may be recoverable under a temporary protection extension in a contract works policy, provided there is existing physical damage to the insured property, even where those costs are not recoverable under the general insuring clause. 'Dewatering operations' in a construction insurance exclusion means the removal of water from a place to enable construction works to proceed, and does not extend to water management activities undertaken for protective or flood mitigation purposes. A term indemnifying the insured for loss prevention expenditure cannot be implied into a policy that expressly requires the insured to act at its own expense to minimise third party injury or damage.
