Where a development consent condition requires geotechnical or other investigative work to be undertaken after demolition is complete, the demolition must have been carried out in accordance with the consent for the subsequent work to be authorised. Geotechnical work undertaken after unlawful demolition cannot constitute work 'relating to' the consented development for the purposes of preventing lapsing under s 95(4) of the EPA Act. The scope of PCA appointment requirements under Condition 55a-type conditions does not extend to preliminary geotechnical investigations.
